These terms are an agreement between you and Samir Patel, doing business as Count the Crumbs (“Count the Crumbs”, “we”) for using countcrumbs.com and the Count the Crumbs apps (together, “the service”). By creating an account or using the service, you agree to them. If you use it for a business, you agree on its behalf and confirm you’re allowed to.

Our Privacy policy explains how we handle your data.

01

The service

Count the Crumbs helps restaurants keep track of ingredients and counts, deliveries and orders, recipe costs, schedules and team, sales and costs. Some features are optional: Ask Crumb (an AI assistant), the Agents, point-of-sale connections and emails sent for you. Some features may be marked as in development; they may change or be withdrawn.

02

Your account

  • An account owner, who accepts these terms for a business, must be 18 or older.
  • A team member a restaurant invites to sign in must be 16 or older.
  • Give accurate details when you sign up.
  • Each account is for one person. Keep your password private, and tell us at samir@countcrumbs.com if you think someone else has used your account.
  • You’re responsible for what happens under your account.
03

Your restaurant and your team

The account that creates a restaurant workspace owns it. The owner decides who to invite and what role each person has. Each role sees and does what that role allows, and the owner sets a few choices, such as who can add to the schedule and whether Managers can delete ingredients. Owners are responsible for their team’s use of the service, and for having the right to record the information they enter about their team (for example pay rates and phone numbers) and telling their team they use Count the Crumbs.

A restaurant may list younger staff on its roster without a sign-in. That information is the restaurant’s own records.

04

Your data

Your restaurant’s records belong to you. You give us permission to store, copy, process and show them only as needed to provide the service to you and your team, as described in our Privacy policy. We don’t sell your data. You can export it from Settings › Your data at any time.

You’re responsible for the records you enter and for keeping your own copies of anything you can’t afford to lose.

05

Ask Crumb and the Agents

Ask Crumb uses an outside AI service to answer questions, read photos and suggest changes. The Agents suggest changes using the app’s own rules. Their answers and suggestions can be wrong or out of date, so check them before you rely on them.

  • Nothing Ask Crumb or the Agents suggest changes your records, places an order or sends anything unless you, or a setting you chose, allows it. Orders they make are drafts until you place or send them.
  • They don’t give professional advice. Don’t rely on them for food safety, allergens, legal, tax, payroll or accounting decisions.
  • Ask Crumb use is limited by your plan’s allowance. We may change which AI models we use, and the allowances, to keep the service running.
06

Emails and orders you send

When you send a team invitation, a supplier order or another email through Count the Crumbs, you choose the recipient and confirm what is sent. Supplier orders and emails sent for you go out with your email address as the reply address. You’re responsible for those messages and for your agreements with your suppliers. Prices in an order are estimates from your last recorded costs, not a quote, and an order isn’t confirmed until your supplier confirms it.

Don’t use these features to send unsolicited or unlawful messages.

07

Point-of-sale connections

If you connect Square or Clover, you also agree to their terms. We only read the data you choose to share, and you can disconnect at any time. We can’t control or be responsible for those services.

08

Plans and fees

No payments are taken in the app today. If your plan has a fee, we’ll agree the amount and how it’s billed with you in writing before you’re charged.

A restaurant in a free pilot uses the service at no charge and as is. We may change or end the pilot with notice to you.

09

Acceptable use

Don’t use the service to break the law or anyone’s rights; try to get into accounts or data that aren’t yours; interfere with or overload the service; copy, scrape or resell it; upload malicious code; or get around its limits or security.

10

Changes and availability

We keep improving Count the Crumbs, so features may change. We aim to keep it running, but we don’t promise it will always be available or free of errors, and it may be down for maintenance.

11

Ending

You can stop using Count the Crumbs at any time. To close your account and delete your data, email samir@countcrumbs.com: we delete it within 30 days of your request. Export anything you want to keep first. We may suspend or close an account that breaks these terms or puts the service or other people at risk, and we’ll tell you when we do unless the law or safety prevents it.

12

Disclaimers

To the extent the law allows, the service is provided “as is” and “as available”, without warranties of any kind, including fitness for a particular purpose, accuracy and non-infringement. Figures such as food cost, stock levels, forecasts and staffing suggestions are estimates based on the records entered.

13

Limits on liability

To the extent the law allows, we aren’t liable for indirect, incidental, special or consequential losses, or for lost profits, revenue or data. Our total liability for any claim about the service is limited to the amount you paid us for it in the 12 months before the claim, or $100, whichever is more.

You agree to cover our reasonable costs from claims that arise from your misuse of the service or from breaking these terms.

14

Transferring these terms

We may transfer these terms to a company we form or that takes over the service, with notice to you.

15

Governing law

These terms are governed by the laws of the State of Texas. Disputes will be handled by the courts of Texas, unless the law where you live says otherwise.

16

Changes to these terms

When we change these terms we’ll update the date at the top. If a change matters, we’ll tell account holders by email or in the app before it takes effect. Using the service after that means you accept the new terms.
